Game developers like you to buy their games new, they get more money that way. To help combat used game sales, developers will offer free DLC on games that you buy. The problem lies when purchasing a used game with the DLC already downloaded. Plaintiff James Collins case is that Gamestop didn’t make clear that the used game he bought didn’t have the free DLC, when on the box it said it did.

“GameStop, who makes more than 20% of its revenue and nearly $2 billion from the sale of used video games, is aware of this issue, and continues to fail to alert customers that this content is not available on used games. As a result, GameStop tricks consumers into paying more for a used game than they would if they purchased the same game and content new.” – lawsuit statement
