Nintendo is entrenched in a lawsuit filed by Seijiro Tomita over what he claims is a patent infringement over 3D display without the use of 3D glasses.

In 2003, Tomita met with seven Nintendo officials in 2003 to discuss using his license for the technology.  Four of those seven officials ended up heading the 3DS project.  Since the release of the 3DS, Tomita has had trouble selling his technology.

Nintendo argues that meetings for 3D technology began in 2002, before their meeting with Tomita, and has met with several other vendors.  “Mr. Tomita’s meeting was one of hundreds.” said Mr. Lindvall, Nintendo’s attorney in this case.

Furthermore, Nintendo claims a key point of Tomita’s patent, cross-point information, does not match the 3DS designs.

Tomita is suing for $9.80 for each Nintendo 3DS sold.
