I have been keeping an eye on this issue for about three days now, hoping it wouldn’t be that big of a deal. It is sill not a huge issue but big enough to be addressed. There seems to be two different black screens. One, pictured above, when the touch screen become black, and the second when the top screen goes black with words telling you there was an error. Both of the issues can be resolved by restarting your 3DS.

The only comment Nintendo has made about the issue is make sure you do the first 3DS system update before contacting them about the issue. I hear that doesn’t always work. I am sure that the issue can be resolved by a system update. Like any new technology these days there will be a few launch pains and problems.
